1. General terms and conditions
Welcome to Croatiandesignsuperstore.com! This agreement contains the Terms and Conditions of the Use of the website Croatiandesignsuperstore.com (referred as the Service), owned by the Croatian Design Superstore (reffered to hereinafter as the Service Provider).
When a person (referred to hereinafter as the User) accesses and/or uses the Service and/or completes the registration process or orders product(s), it is assumend that the User agrees to the Agreement which conditions have had been read, understood and accepted by the User. These Terms may be updated periodically, which is why the Service advises for the User to read them carefully and regularly take notice of any changes, as they are binding as soon as published. The Service kindly disadvises the use of the Service if he/she is not in accordance with some or any parts of its Terms.
The products sold on Croatiandesignsuperstore.com are sold by Croatian Design Superstore LLC Martićeva 4, 10000 Zagreb, Hrvatska, OIB: 31548321339, IBAN: HR3524840081106985835. Any further information can be given through our Customer Service support by sending an e-mail to: firstname.lastname@example.org.
Access to this Website is permitted on temporary basis, the Service reserves the right to withdraw or amend the Services without notice. The Servicce is not liable if it is, for any reason, unavailable at any time or during any period of time. Periodically, the Service may restrict access to some parts or all of the Website.
2. Use of the Service
The User must be eighteen (18) years old or older to order products from the Service. The Service and images, graphics, drawings and text are protected and we grant you a limited license to access and make personal use of the website. It is forbidden to download any materials from the Service, except where specifically invited, nor to duplicate, sell or modify, any portion of this site without recieving confirmation through written authorization from the Service Provider.
3. Registration and User responsibilities
The User’s registration is complete when he/she has filled out the neccessary information (name, address, phone number/mobile phone number and e-mail address) and choosen a user name and password. Corporate customers must include the trade registry number and/or VAT number. Registration is free of any charges. By registration, the User warrants that he/she had read and agreed to these Terms.
The User is responsible for all activities that occur under his/her account and is solely responsible for maintainting security of his/her password. The user warrants that the information given at registration are true and accurate, and that he/she is over eighteen (18) years of age.
The user has the right to change and/or delete all of his/her information from the register.
We reserve the right to transfer all of the given information provided by the User to the authorities when asked according to law obinding regulations.
5. Ordering and Payment Terms
The service offers bank payments and Credit/Debit Card payments. When choosing bank payments, the user will receive instructions for payment. The delivery process may start only after the Service Provider receives the User’s payment. If paying by Credit or Debit Card, the Service provides secure transactions through WSPay payment system based on SSL 128 bit encryption protocol that guarantees the security of online transactions. Any financial information will not be used for any procedure other than those relevant for purchase, issuing refunds or reporting cases of fraud to the authorities.
6. Pricing and Availability
The product price is the price displayed for the item on the Service at the time of ordering. The cost of products and services may fluctuate depending on exchange rate. All prices advertised are subject to such changes. Please check the final price displayed through the relevant order form.
Though the Service intends to keep all of the details, descriptions and prices accurate, there is a possiblity that errors may occur periodically. The Service kindly asks the User to keep in mind that the image and colors of some, if any products, may not completely correspond to the real garments due to the Internet browser or monitor in use. The Service will distinctly state which products are subject to these differences due to manufacturer’s production methods and used materials. The Service reserves the right to refuse or fill any orders that the User may have placed based on information that contains errors or inaccuracies, including out-of-date informationregarding pricing, shipping, payment terms or return policies. If the Service discovers an error in the pricing of any goods ordered, the Service shall inform the User as soon as possible, offering the User options of reconfirming his/her order at the correct price, or possibility of cancellation of the order at whole. If the Services does not succed to contact the User for his/her prompt response, the Service shall cancel the order, and asussure the full refund if the order has previously been paid.
For periodical promotional purposes, the Service offers promotional discount codes. These Promotional discount codes may reffer to some or all products, and the given benefits will be clearly communicated by the Service along with the conditions of use and valid date. Only one promotion code can be used per order unless stated otherwise on coupon. A promotional code can only be used once and cannot be applied again once the order has been finished and the payment received. The promotional code cannot be exchanged for its value in cash. If the User looses his/her promotional code, the Service is not obliged to provide with a replacement code. The Sevice reserves the right to deactivate the User’s promotional code if there is suspision that the User may have been using the code in an abusive way.
Gift Vouchers are valid 3 months from the date of issue, and must be spent through one order.
Delivery cost is charged depending on country of delivery. Charges are 35kn (approx. 5€) per order for Croatia. For the rest of the countries the cost may vary depending the size and/or the weight of the items and is specified at Shipping and Delivery. All the product prices and delivery charges include VAT and are displayed in Kuna’s (KN) and euros (EUR). Delivery cost is clearly included in Checkout process. Delivery times may vary depending on destination. The Service won’t take responsibility for any delays resulting from postal delays or force majeure.
Orders made from a Country site where Service cannot ship, will be automatically cancelled.
8. Cancellation and returns
User has a right to return or exchange product during a fourteen-day period, starting the day the User received order. This possibility is given and conducted according to Croatian consumer protection legislation. This return policy won’t be extended to products which are produced or altered according to the User’s wishes. Should User wish to return purchased product, Service advises User not to remove tags and/or seals while trying out the product.
Possibility of product return will be given to User if:
- The order had been cancelled according to this Terms and Conditions and if Service was noticed within 14 days of delivery;
- The product has not been used, worn, washed, modified or damaged;
- The product is in the same condition as it was upon delivery and all the parts of the product are included in the package;
- The product has been repackaged into its original package.
The User may download the Return Authorization Request which is mandatory document in return process here. User must fulfill this request to start the return or exchange process.
The product must be returned immediately after cancellation, not later than 14 days upon delivery. When returning products, User will be responsible for the risk of damages. The order will be refunded only when and if the product that matches above mentioned terms is delivered to Service Provider. The shipping cost of returning order is at User’s expense.
When receiving User’s product, Service will notify User claiming if the Service accepts return. In case that the Service finds that User’s return does not match here noted conditions, User may choose to have product delivered back to him/her at no expense of Service. If User refuses such an option, the Service reserves the right to retain the products and the amount paid for User’s purchase of the products.
If User has noticed damage or defect on product or there was an error on Service’s part, please notify Service by mail, providing photographs and full description of faulty within 8 days of receipt. If the product becomes faulty after 8 days, Service will do its best to remove all the flaws in accordance with Croatian laws. If the User is, upon the mutual agreement, returning above mentioned product, the cost of delivery is on Service. If Service finds the product defected, damaged or wrongly dispatched to User by its own mistake, User may decide if he/she would like refund or delivery of new product. User must return the product in the same condition in which he/she had received them. User has a legal obligation to take reasonable care of the products whilst they are in his/her possession. If User fails to comply with this obligation, Service may have a right of action against his/her’s request for compensation.
The Service will examine all products returned as damaged or defective and will notify User by e-mail within reasonable period of time. The Service will try to process User’s complain as soon as possible and at no longer than 30 days. In the event that the Service finds no fault with the returned products, User will be notified that the returned products cannot be accepted and User may select to have the products re-delivered back to him/her. If User does not accept re-delivery the Service reserves the right to retain the products and the purchase price and recover the Service’s fees and expenses from User.
When making a refund of payment, the full amount will be made to the individual who made the payment and not to the recipient of products indicated on the order. The refund will be made using the same payment method that was originally used by User to pay for the purchase and will include the total cost of order. The Service will try to make refund as soon as possible. The time period for refunding the amount that User paid for purchasing the returned products depends on the payment type used. The Service shall not be responsible for any delay that is beyond its control including for delays caused by the method of purchase or refund, including by way of example delays caused by Credit Card/Debit Card companies refund policies.
9. Legal terms and Issues
These Terms and Conditions are to be construed in accordance with Croatian laws and in the event of any dispute or claim associated with these Terms and Conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Croatian courts.
The parties have agreed that this Agreement and related documents shall be written in English.
